Terms of Service

These Terms of Service ("Terms") govern your use of ScaleBuilder (the "App"), operated by ScaleBuilder Technologies ("ScaleBuilder," "we," "us," or "our"). By installing or using ScaleBuilder, you agree to these Terms.

1. Service Description

ScaleBuilder is an AI-powered advertising assistant that helps Shopify merchants create, manage, and optimize advertising campaigns on Meta platforms (Facebook and Instagram). The App connects to your Shopify store and Meta ad account to provide campaign management services.

2. Eligibility

You must be at least 18 years old and have a valid Shopify store to use ScaleBuilder. By using the App, you represent that you have the authority to bind yourself or your business to these Terms.

3. Account and Access

  • You install ScaleBuilder through the Shopify App Store or via scalebuilder.io
  • You authorize access to your Shopify store data and Meta ad account through their respective OAuth flows
  • You are responsible for maintaining the security of your connected accounts
  • You must not share access or allow unauthorized use of your account

4. Billing and Payments

All paid features, if applicable, are billed through the Shopify Billing API. Charges appear on your regular Shopify invoice. Pricing is as displayed in the App and on the Shopify App Store listing at the time of purchase.

5. Advertising and Ad Spend

  • ScaleBuilder creates and manages Meta ad campaigns on your behalf based on your instructions
  • You are responsible for all ad spend incurred on your Meta ad account. ScaleBuilder facilitates campaign management but does not control Meta's billing for ad spend.
  • Campaign performance is not guaranteed. Advertising results depend on many factors outside our control, including market conditions, creative quality, and platform algorithms.
  • You are responsible for ensuring your ads comply with Meta's Advertising Policies and all applicable laws.

6. AI-Generated Content

ScaleBuilder uses AI to generate ad creatives (images, copy, headlines). You are responsible for reviewing and approving all AI-generated content before it goes live. We do not guarantee that AI-generated content is free from errors, and you should verify all content for accuracy and compliance with advertising regulations.

7. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose
  • Promote prohibited products or services through the App
  • Attempt to reverse-engineer, decompile, or access the source code of the App
  • Interfere with or disrupt the App's infrastructure
  • Exceed reasonable API usage that degrades service for other users

8. Intellectual Property

  • ScaleBuilder and its underlying technology, branding, and documentation are owned by ScaleBuilder Technologies
  • Ad creatives generated through the App are yours to use as you see fit
  • You retain ownership of all your Shopify store data and Meta ad account data

9. Privacy

Your use of ScaleBuilder is also governed by our Privacy Policy. By using the App, you consent to the data practices described therein.

10. Disclaimer of Warranties

ScaleBuilder is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that campaign results will meet your expectations.

11. Limitation of Liability

To the maximum extent permitted by law, ScaleBuilder Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, lost profits, or loss of data, arising out of or related to your use of the App.

Our total liability for any claim arising from these Terms or the App shall not exceed the amount you paid to ScaleBuilder in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless ScaleBuilder Technologies from any claims, damages, or expenses arising from your use of the App, your ad content, or your violation of these Terms.

13. Termination

  • You may uninstall ScaleBuilder at any time through the Shopify App Store
  • We may suspend or terminate your access if you violate these Terms
  • Upon termination, we will delete your data in accordance with our Privacy Policy

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the App. Continued use after changes constitutes acceptance.

15. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.
